Simple proof that James McGibney is a moronic blowhard who employs a heroin addled e-detective to support his LOLSUIT practice.


A premise which seems foolish upon initial inspection to those with any knowledge, the idea that these two IP addresses represent the same person.

Slightly different returns from trace routes for 69.123.131.152 on hop 16, while two different devices respond on hop 16 for 69.121.50.17? This is a redundant pair of routers running a load sharing interior gateway protocol, most likely the open standard link state protocol OSPF. 167.206.34.2 is likely an HSRP (virtual) address shared by the two devices.


Maintenance of reverse lookups is slack at best, but 167.205.34.0/24 is clearly an infrastructure subnet for an ISP the size of Optimum Online, so this is probably less inaccurate than one would expect from a /24 picked at random. Where you see two numbers in the table below with many missing digits between them this indicates the same naming scheme was repeated.


‘cmts’ is short for ‘cable modem termination system’, a general term, not a brand

‘ubr’ is likely a Cisco Universal Broadband Router, a type of CMTS

‘ge’ denotes a gigabit interface

‘opti’ might be a CMTS brand or given the numbering it might be tied to an asset management system.



So there are two devices at hop 16, seen from the perspective of route-views.oregon-ix.net, that share the duty of making 167.206.34.2 available to a cloud of about 200 cable modem termination systems scattered around Nassau county, which is on Long Island, just east of New York City. A small CMTS like an older Cisco UBR can handle hundreds of customers while newer units can support thousands.


Chronologically the two IP addresses were observed more than a year apart. Most ISPs protect customer privacy by maintaining logs for a minimum amount of time. This is governed by a standard known as CALEA - the Communications Assistance for Law Enforcement Act. This act only provides for the retention of records for 90 days based on request. In practice most ISPs are keeping six months to a year of records. Responsiveness to civil procedure versus criminal investigation requests can vary broadly.




Point by point:


1. McGibney can’t even show a docket number for a federal lawsuit


2. If there were a federal lawsuit a visit from an IP address probably isn’t grounds for discovery


3. If discovery were attempted the IP user would easily quash such a broad, silly request


4. Even if discovery were permitted on the newer IP the older one has already fallen off the logs
